1. Who we are

This site is operated by FROUDE, BLAKE ALEXANDER, ABN 69165998133, trading as Marked Golf, of PO Box 2453, Rowville VIC 3178.

Where these terms say "we", "us" or "our", that is who they mean. "You" means anyone buying from or using this site.

2. About these terms

These terms apply every time you use markedgolf.com.au or place an order with us. By ordering you accept them, so it is worth a read before you do.

We may change these terms. The version on this page at the time you order is the version that applies to your order, and changing them later does not change a deal already done.

3. Ordering

When you place an order you are making an offer to buy. A contract forms when we send you an order confirmation email.

We may decline or cancel an order before it ships, and if we do we refund you in full. Reasons this might happen: the item is no longer available, there was a pricing or description error, we cannot deliver to your address, or we think the order is fraudulent.

You need to be at least 18 to order.

4. Pre-orders

Everything on this site is currently sold as a pre-order, which means the goods do not exist in our hands yet. It matters enough to spell out.

You pay when you order, not when it ships. That is how the first production run is funded.
The expected dispatch date is stated on every product page and in your confirmation email. As at the date of these terms that is from mid-September 2026.
Dates are estimates made in good faith. We give them on the basis of what our manufacturer has told us, and we tell you as soon as anything changes.
If the date moves, we email you with a new date and the option of a full refund, and you do not have to accept a delay you did not sign up for.
You can cancel any time before it ships for a full refund. See clause 8.

If we are ever unable to supply what you ordered at all, we refund you in full. That is the floor, and it is not conditional on anything.

5. Prices and payment

Prices are in Australian dollars and include GST where it applies.

We can change prices at any time, but not on an order we have already confirmed.

Payment is taken at checkout through Shopify's payment providers. We do not see or store your full card details.

If a product is listed at an obviously wrong price, we will contact you before doing anything, and you can confirm at the correct price or cancel for a full refund.

6. The Founding 30 offer

Where we offer a free Monogram marker with the purchase of two or more markers:

It applies to the first 30 qualifying pre-orders, which is the size of the first Monogram run.
We may withdraw or change it at any time before you order. Once your order is confirmed, what you were promised is what you get.
The free marker has no cash value and cannot be exchanged for a discount.
If you return part of an order and it takes you below two markers, we may deduct the value of the free marker from your refund, or you can send it back with the rest.

7. Delivery

Delivery is covered in full in our shipping policy, which forms part of these terms.

Risk in the goods passes to you on delivery.

8. Cancelling, returns and refunds

Before it ships. Cancel any pre-order for a full refund by replying to your confirmation email or writing to support@markedgolf.com.au. No reason needed.

After it arrives. Our refund policy sets out the change-of-mind window and how to return something.

If something is faulty. Clause 9 applies, and it sits above anything in this clause.

Refunds go back to the payment method you used. Banks usually take a few business days after we process it.

9. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies those rights. Where anything here conflicts with them, the Australian Consumer Law wins.

10. Our liability

Subject entirely to clause 9, and to the extent the law allows:

Our total liability for any order is limited to what you paid for it.
We are not liable for indirect or consequential loss, including lost profits or lost opportunity.
We do not promise the site will be uninterrupted or error free.

None of this limits liability that cannot be limited by law, including for fraud, death or personal injury caused by our negligence, or under the consumer guarantees.

11. Intellectual property

The Marked Golf name and logo, the marker designs, and the artwork,
photography and words on this site are either ours or used with permission.

Copyright in them is protected under the Copyright Act 1968 (Cth), which
applies automatically from the moment a work is created and does not
depend on registration.

You may not reproduce, manufacture, import or sell our designs, or anything
substantially similar to them, without written permission from us.

12. Using this site

Do not use this site to break the law, interfere with how it works, scrape it at scale, or attempt to access parts of it you have no business in.

If you create an account you are responsible for keeping the password to yourself and for what happens under it.

13. Privacy

We handle personal information in line with our privacy policy and the Privacy Act 1988 (Cth).

14. If we cannot perform

We are not liable for delay or failure caused by something genuinely outside our control, including manufacturing failures at our supplier, freight and customs delays, natural disasters, or industrial action.

This does not remove your right to a refund if we cannot deliver what you ordered. It means we are not additionally liable for the delay itself.
